Unlocking School Healthcare: Research Deadlines and Key Considerations

Senate Bill 1444, passed by the Texas legislature in 2021, allows school districts to enter or leave the state’s health insurance program, TRS-ActiveCare. However, after deciding to leave, a district must remain out of the TRS-ActiveCare program for five years.

Before committing to any change, it’s important to do your homework, survey the data, and weigh your options to make an informed decision. Below are some actions and deadlines you may find helpful when considering healthcare plan options for your district’s employees.

September: Request Data from TRS

To ensure August data is captured, submit your request to TRS during September and early October. Districts can request TRS Summary Health Information vs. De-Identified Data through the TRS RE Portal. Expect at least a 10-business-day turnaround.

October: Create Medical Insurance Committee

With data in hand, the stakeholders on this committee should consider all aspects of a healthcare plan, not just the cost. Consider creating a committee that represents a diversified segment of many of the district’s employee types.  Have your benefits department lead the charge with surveys, and workshops, and maybe consider inviting consultants and other subject matter experts. 

November: Request Quotes from Providers

Some questions for brokers should include such topics as:

  • Funding type and service
  • Prescription coverage
  • Network access
  • Premiums and risk

December: District Decision-Making Process

Now is the time to ensure your school board supports your decision. Per SB1444, you must have documentation of support from your governing body. Be sure to secure interlocal agreements for your provider of choice as well. You must notify TRS of your intent to leave before 12/31 of the year prior to the plan year in which you wish to leave (e.g., 12/31/24 for 9/1/25 plan year). Once the Notice of Election to Discontinue is complete, and TRS issues a notice of acceptance, the decision cannot be changed. Once TRS accepts the submitted notice, it is binding and cannot be reversed.
